Welcome to HomeFacts Pro. These Terms and Conditions govern your access to and use of the HomeFacts Pro application, website, software, services, features, tools, and related content. By creating an account, accessing the app, uploading information, scheduling services, sending documents, or using any feature of HomeFacts Pro, you agree to these Terms and Conditions.

If you do not agree to these Terms, you should not use HomeFacts Pro.

1. Purpose of HomeFacts Pro

HomeFacts Pro is designed to help homeowners, home inspectors, real estate professionals, contractors, subcontractors, property managers, and related users organize property information, inspection data, photos, documents, service records, agreements, payments, communications, and maintenance history.

HomeFacts Pro may include tools for property documentation, inspection report support, AI-assisted photo review, client portals, scheduling, contractor coordination, digital documents, and related services.

HomeFacts Pro is intended to assist users with organization, communication, and documentation. It does not replace professional judgment, licensed inspections, contractor evaluations, engineering opinions, legal advice, tax advice, insurance advice, or government approval.

2. User Responsibilities

By using HomeFacts Pro, you agree to:

  • Provide accurate and truthful information.
  • Use the app only for lawful purposes.
  • Keep your login credentials secure.
  • Review all information before relying on it or sharing it with others.
  • Obtain proper authorization before uploading documents, photos, reports, agreements, or personal information.
  • Comply with all applicable local, state, and federal laws.
  • Use professional judgment when reviewing inspection findings, contractor notes, AI-generated content, or property records.

You are responsible for the information you enter, upload, share, approve, or distribute through HomeFacts Pro.

3. Accounts and Access

Users may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account username, password, and login information.

You agree not to share your login credentials with unauthorized users. You are responsible for all activity that occurs under your account.

HomeFacts Pro reserves the right to suspend, restrict, or terminate access to any account if misuse, unauthorized access, fraudulent activity, abuse, or violation of these Terms is suspected.

4. AI-Assisted Features

HomeFacts Pro may include artificial intelligence features that assist with photo analysis, defect recognition, report drafting, recommendations, impacts, technical references, categorization, summaries, and other property-related documentation.

AI-generated content is provided as a support tool only. AI may produce incomplete, inaccurate, outdated, or incorrect information. AI-generated findings must be reviewed, edited, approved, or rejected by a qualified user before being relied upon or included in any final report, document, estimate, recommendation, or communication.

HomeFacts Pro does not guarantee that AI will identify every defect, hazard, code issue, safety concern, construction error, or maintenance need. Users remain responsible for verifying all findings.

AI-generated technical references are for general informational purposes only and should not be treated as a final code determination unless verified by a qualified professional or authority having jurisdiction.

5. Inspection and Property Information Disclaimer

HomeFacts Pro may be used to store, create, or share inspection-related information. However, HomeFacts Pro itself does not perform home inspections, commercial inspections, engineering evaluations, pest inspections, environmental testing, appraisal services, legal reviews, or contractor repairs unless specifically provided under a separate written agreement by a qualified service provider.

Any inspection report, property condition note, repair recommendation, or maintenance record created through HomeFacts Pro is based on the information entered by the user, inspector, contractor, or other authorized party.

HomeFacts Pro does not guarantee that a property is free of defects, code violations, safety hazards, hidden damage, environmental concerns, or future maintenance needs.

6. No Professional Advice

Information provided through HomeFacts Pro is for general informational and organizational purposes only. It should not be considered legal, financial, tax, insurance, engineering, architectural, environmental, medical, or professional advice.

Users should consult qualified professionals when making decisions related to property purchases, repairs, safety concerns, structural issues, environmental hazards, legal obligations, tax matters, insurance claims, or code compliance.

7. Documents, Photos, and User Content

Users may upload photos, inspection reports, agreements, receipts, invoices, maintenance records, warranties, contractor estimates, and other property-related documents.

By uploading content to HomeFacts Pro, you confirm that you have the legal right or proper authorization to upload, store, use, and share that content.

You retain ownership of the content you upload. However, you grant HomeFacts Pro permission to store, process, display, organize, analyze, and transmit that content as needed to provide the app’s services.

You agree not to upload content that is unlawful, harmful, misleading, defamatory, infringing, abusive, obscene, fraudulent, or that violates the privacy or rights of others.

8. Client Portal and Shared Information

HomeFacts Pro may allow users to share property information, inspection reports, agreements, photos, documents, maintenance records, contractor updates, and other information with clients, real estate agents, contractors, property owners, or other authorized users.

You are responsible for confirming that the correct information is shared with the correct recipient. HomeFacts Pro is not responsible for damages caused by incorrect sharing, unauthorized forwarding, user error, incomplete information, or reliance on information shared through the app.

9. Payments and Third-Party Services

HomeFacts Pro may allow users to accept or process payments through third-party payment providers, including credit cards, online payment platforms, or other supported payment methods.

Payment processing may be subject to separate terms, fees, policies, and privacy practices of the third-party payment provider. HomeFacts Pro is not responsible for payment processor errors, declined transactions, chargebacks, processing delays, third-party fees, or unauthorized transactions caused by third-party platforms.

Users are responsible for reviewing all payment details, pricing, taxes, refunds, and service terms before completing a transaction.

10. Agreements and Electronic Signatures

HomeFacts Pro may include features for sending, signing, storing, or managing inspection agreements, service agreements, contractor agreements, client acknowledgments, and related documents.

Electronic signatures and digital acknowledgments may be legally binding depending on applicable law. Users are responsible for ensuring that agreements are accurate, complete, properly reviewed, and legally appropriate for their business and location.

HomeFacts Pro does not provide legal advice and does not guarantee that any agreement template complies with all applicable laws.

11. Contractor and Third-Party Communications

HomeFacts Pro may allow communication between homeowners, inspectors, contractors, subcontractors, real estate professionals, and other third parties.

HomeFacts Pro is not responsible for the actions, omissions, work quality, estimates, pricing, licensing, insurance, warranties, delays, disputes, or representations of any contractor, inspector, real estate professional, or third party.

Users should independently verify licensing, insurance, qualifications, references, pricing, and scope of work before hiring or relying on any third party.

12. Data Accuracy and Availability

HomeFacts Pro works to provide useful tools for organizing and managing property information. However, we do not guarantee that all data, reports, documents, AI results, notifications, reminders, or stored information will always be accurate, complete, current, or available.

Users should keep backup copies of important records, agreements, reports, receipts, photos, and documents.

HomeFacts Pro is not responsible for loss of data, service interruptions, software errors, device issues, internet outages, or third-party platform failures.

13. Prohibited Uses

You agree not to use HomeFacts Pro to:

  • Violate any law or regulation.
  • Upload false, misleading, or fraudulent information.
  • Access another user’s account without permission.
  • Interfere with the security or operation of the app.
  • Reverse engineer, copy, modify, or exploit the software.
  • Upload malware, harmful code, or unauthorized files.
  • Harass, threaten, abuse, or defame others.
  • Misrepresent inspection findings, property conditions, credentials, licensing, or professional qualifications.
  • Use AI-generated content as a final professional determination without proper review.

14. Intellectual Property

HomeFacts Pro, including its name, branding, design, software, features, workflows, templates, text, graphics, logos, and related materials, is owned by or licensed to the company operating HomeFacts Pro.

Users may not copy, reproduce, distribute, sell, modify, or create derivative works from HomeFacts Pro content or software without written permission.

User-uploaded content remains the property of the user or rightful owner, subject to the permissions needed for HomeFacts Pro to provide services.

15. Subscription, Fees, and Billing

Some HomeFacts Pro features may require payment, subscription, or service fees. Pricing, billing terms, renewal periods, cancellation policies, and available features may vary depending on the selected plan.

By purchasing a paid plan or service, you agree to pay all applicable fees. Failure to pay may result in suspension or cancellation of access to paid features.

Subscription fees may be non-refundable unless otherwise stated or required by law.

16. Termination

You may stop using HomeFacts Pro at any time. HomeFacts Pro may suspend or terminate your access if you violate these Terms, misuse the app, fail to pay required fees, create security concerns, or engage in unlawful or harmful activity.

Upon termination, your access to certain features, data, reports, or documents may be limited or removed. Users are responsible for downloading or saving important records before canceling or ending use of the app.

17. Limitation of Liability

To the fullest extent permitted by law, HomeFacts Pro, its owners, employees, contractors, affiliates, developers, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or financial damages arising from your use of the app.

This includes but is not limited to damages related to property defects, missed findings, inaccurate AI output, inspection errors, contractor disputes, lost data, failed payments, delayed communications, lost profits, legal claims, repair costs, safety issues, or reliance on information provided through the app.

HomeFacts Pro’s total liability, if any, shall not exceed the amount paid by the user for the service during the applicable billing period, unless otherwise required by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless HomeFacts Pro, its owners, employees, contractors, affiliates, developers, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use or misuse of the app.
  • Your uploaded content.
  • Your violation of these Terms.
  • Your violation of any law or third-party rights.
  • Your reliance on AI-generated or user-generated content.
  • Your professional services, inspections, reports, estimates, repairs, or communications.

19. Privacy

Use of HomeFacts Pro is also governed by the HomeFacts Pro Privacy Policy. The Privacy Policy explains how information may be collected, used, stored, shared, and protected.

By using HomeFacts Pro, you agree to the terms of the Privacy Policy.

20. Updates to These Terms

HomeFacts Pro may update these Terms and Conditions from time to time. Changes may be posted in the app, on the website, or otherwise communicated to users.

Continued use of HomeFacts Pro after updates are posted means you accept the revised Terms.

21. Governing Law

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

Any disputes shall be handled in the appropriate courts or dispute resolution forum located in Houston County, Georgia, unless otherwise required by law.

23. User Acknowledgment

By creating an account, accessing HomeFacts Pro, uploading content, using AI-assisted tools, sending documents, processing payments, or using any app feature, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
